1. Introduction

Welcome to ReviewInstant! These Terms and Conditions govern your use of our services, provided by ReviewInstant, a Limited Liability Company registered in Denmark with a registered address in Aalborg 9000, Denmark. Please read these Terms and Conditions carefully before using our services. By purchasing our services, you agree to be bound by these Terms and Conditions. If you do not agree with these terms, please do not access our services.

2. Service Overview

ReviewInstant specializes in assisting contractors in acquiring more reviews and optimizing their profiles on their desired platforms.

3. Acceptance of Terms

By agreeing to pay for our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. 

4. User Obligations & Responsibilities

Clients are responsible for utilizing the provided Smart Review Card or our Review System to collect reviews actively. The success and effectiveness of our service largely depend on the client’s active participation and usage of the card. Clients are expected to use the services ethically and responsibly. 

4.1 Reportings each month

Clients accept that we track their data using Google API. The data will be presented for the client each month. The data shows, their positions for their primary keyword, business impressions, calls, business direction requests and website clicks. 

The data presented is directly from Google API, and not something we control. 

5. Intellectual Property

All content included on our website, including text, graphics, logos, images, is our property or the property of our licensors and protected by international copyright laws. We hold the rights to all stock images used, as they are purchased and legally obtained.

In some cases we would allow the client to keep our intellectual property, and may use it as they wish.

5.1 Recordings

As part of our commitment to continuous improvement, we maintain audio recordings of our meetings and calls. We do not record screens, nor do we capture the personal images or faces of our clients. These recordings are retained for a period of 50 days and are used solely for the purpose of enhancing the skills of our personnel. In certain cases, these recordings may be utilized to address instances of unjust behavior. They can also be employed in legal proceedings to aid in judicial determinations.

6. Payments, Cancellations, and Refunds

Clients can cancel at any time. Services will cease immediately upon cancellation, and clients will no longer be billed by the end of their billing cycle.

Cancellation is done through email or inside our client portal. 

We offer a money-back guarantee if our services do not yield results, provided clients have made the utmost effort to utilize the services appropriately.

6.1 When is a money-back guarantee possible?

A money-back guarantee is not applicable if we, as a company, can demonstrate that after the client has subscribed to one of ReviewInstants’ services, there is a positive effect during the active subscription period.

Definition of “Positive effect”:

The client has improved their rankings for their main keyword in the geogrid map.

or

The client has a higher percentage of calls, business impressions, or map direction requests.

In all other cases, a refund would be applicable. We will use Google API described in 4.1, to determine the positive effect, so the determination would be objective.

6.2 When is a refund not possible?

Actions taken by Yelp, Google, Facebook, or any other platform regarding your account, is out of our control. 

We cannot be held responsible for their actions, nor do we do anything that goes against their policies, since we are a certified partner.

Examples: Account suspension, verification issues, duplications, negative reviews, and other problems not directly related to our services.

Nevertheless if we still can’t prove a positive effect, we’ll return your investment back.

6.2  Client abuses the money-back guarantee

In the event that a client is not eligible for a refund, as outlined in the reasons above, and still persistently attempts to dispute or obtain a refund, we will take the necessary actions to prevent this unjust behavior, which may lead to a complete suspension of an account from the platform. 

7. Limitation of Liability and Disclaimer

ReviewInstant makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability with respect to the services for any purpose. To the fullest extent permissible by applicable law, ReviewInstant disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

8. Termination

We reserve the right to terminate agreements if we find that clients are misusing or abusing our services inappropriately. The termination will be effective immediately, and clients may lose access to our services.

9. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Denmark. Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Denmark.

10. Privacy Policy

11. Changes to Terms and Conditions

We may revise these Terms and Conditions from time to time. If we make significant changes, we will notify all clients by email.
